Petikaa Gift Studio requires You to agree not to use the Website, and specifically prohibit any use of the Website, for any of the following purposes:

b. Posting any information which is untrue, inaccurate or not your own;

You agree to indemnify, hold harmless, and defend Petikaa Gift Studio, its parent, subsidiaries, divisions, and affiliates, and their respective partners, employees, agents and affiliates from any and all claims, liabilities, damages, costs and expenses of defence, including attorneys’ fees, in any way arising from or related to your illegal use of the Website, your violation of these Terms or the Privacy Policy, defamatory or infringing content posted to the Website by You, or Your violation of any law or the rights of a third party.

3. Notices and Electronic Communication

When You visit Website or e-mail Petikaa Gift Studio, You are communicating with Petikaa Gift Studio electronically. By communicating with Petikaa Gift Studio, You consent to receive communication from Petikaa Gift Studio electronically. Petikaa Gift Studio will communicate with You by e-mail or by posting notices on the Website. You agree that all agreements, notices, disclosures, and other communications that Petikaa Gift Studio provides to You electronically satisfies any legal requirement that such communication be in writing.

4. Terms and Conditions are Binding on all Purchases

a. All orders are deemed offers for You to purchase our products or/and services. Petikaa Gift Studio may accept your offer by issuing a confirmatory e-mail and/or mobile confirmation of the products specified in Your order. Petikaa Gift Studio’s acceptance of each such offer is expressly subject to and conditioned on Your assent to these Terms and Petikaa Gift Studio’s Privacy Policy.

b. Petikaa Gift Studio reserves the right, with or without prior notice, to do any one or more of the following: (i) limit the available quantity of or discontinue any product or service; (ii) impose conditions on the honouring of any coupon, coupon code, promotional code, or other similar promotion; (iii) bar You from making or completing any or all sale transaction(s); and (iv) refuse to provide You with any product or service.

c. You agree that by placing an order on the Website, You are entering into a binding contract with Petikaa Gift Studio and agree to pay all charges and taxes that may be incurred by you or on your behalf through the Website, at the price(s) in effect when such charges are incurred including, without limitation, all shipping, taxes and handling charges.

5. Product Information and Inventory

Excluding any content that may be submitted by You from time to time, Petikaa Gift Studio strives to ensure that the information on the Website is complete and reliable. Certain information may contain pricing errors, typographical errors and other errors or inaccuracies, which Petikaa Gift Studio may correct without liability. Petikaa Gift Studio also reserves the right to limit quantities purchased by You and to revise, suspend, or terminate an event or promotion at any time without notice (including after an order has been submitted or acknowledged). Petikaa Gift Studio does not guarantee that all products described on the Website will be available.

6. Payment

All payments must be received by Petikaa Gift Studio prior to shipment of Order. Petikaa Gift Studio accepts payment by net banking, credit card, debit card and cash on delivery. 

7. Order Processing

a. Subject to Clause 7 (b), orders received are usually processed within two Business Days for stock held readily at Petikaa Gift Studio’s warehouse. Delivery timeline for Personalised products may be 20 business days excluding shipping. For the purpose of this Term, the term “Business Days” shall mean, excluding Saturday and Sunday, Indian Bank Holidays.
 
b. Petikaa Gift Studio provides expedited shipping upon the customer opting for the same at checkout.

8. Shipping and Handling

a. Subject to return of products under Clause 9 (a)(i), Petikaa Gift Studio offers standard & Express shipping all over India on all pre-packed boxes and products. For the purpose of this clause 8, pre-packed boxes shall mean and include such boxes, bags and packages that are curated, designed and packed by Petikaa Gift Studio exclusively. Standard shipping and express shipping options are available on all products, based on availability, and shall be charged in addition to the price of selected product. Such shipping fees shall be as displayed on product checkout.
 
b. You acknowledge that shipping and delivery schedules are estimates only and cannot be guaranteed. Petikaa Gift Studio is not liable for any delays in shipments. Title and risk of loss and damages pass on to You upon product(s) delivery or service rendered to You.

c. Shop orders, ready in stock, will ship within 2 (two) Business Days of being processed as per clause 7 for all in-stock items. Petikaa Gift Studio will email Your tracking information as soon as possible.

9. Return of Products and Replacements

a. Petikaa Gift Studio offers a 1 week replacement warranty for all products sold on its Website, under certain conditions mentioned here in below:

i. You will notify Petikaa Gift Studio of any defect within 24 hours from the date of receipt of delivery of the products, provided such return is for reasons limited to damage during shipment, packaging defect, incomplete packaging, wrongly delivered or wrong product. Products should be returned in their original packaging to qualify for replacement. Shipping and handling charges for return of such defective products and replacement shall be borne by the customer.

ii. Petikaa Gift Studio shall not be held responsible and liable for variation of appearance or display of products on its Website.

iii. In the event that You fail to inform Petikaa Gift Studio within the stipulated time frame and condition set out in Clause 9(a)(i), Petikaa Gift Studio reserves the right to accept or reject such replacement request at its sole discretion.

iv. Petikaa Gift Studio will replace/repair the defective product depending upon the warranty of the product at no extra cost. Petikaa Gift Studio will try to replace the specific product ordered. However, Petikaa Gift Studio reserves the right to offer an alternate product or refund for that particular product in case the returned product is out of stock/ production.

v. You acknowledge that the return and replacement policy is not valid for certain products, including not limited to boxes customized by you, complimentary gifts, food items.

10. Refund Policy

a. You understand and acknowledge that all sales are final and

b. that there shall be no refund of any payment under any event whatsoever.  In the event that You do not want replacement of a defective Product(s) under Clause 9, Petikaa Gift Studio shall offer an in-store credit of the refundable amount, to your Website account within in a maximum of 15 Business Days from the date of receipt of notification of defect in accordance with Clause 9, and will be valid for 1 month from date of issue.

11. Order Changes and Cancellation

a. Any product additions, quantity changes or specification changes made to accepted orders will be modified in the order details.

b. Orders cancelled before shipment, shall be charged a restocking fee 5% of the order value. Orders cannot be cancelled once product(s) have been shipped. Personalised products cannot be cancelled once the order has been placed.

c. Petikaa Gift Studio may, without liability, cancel any accepted order before shipment if our credit department does not approve Your credit or if there are other problems with the payment mode selected by You.

d. Cancellation policy is not applicable on any Membership, Contest, Discounted schemes/offers and Personalised Products.

12. Applicable Law and Dispute Resolution

The Policy herein shall be construed in accordance with and be governed by the laws of India. All disputes arising out of or/and relating to the Policy shall be subject to the exclusive jurisdiction of the Courts in Chennai.

13. Right to digital material

Petikaa Gift Studio holds the right to use pictures and videos of personalized and customized orders on their website, social media, emailers, and other marketing mediums, This includes hampers with corporate logos, wedding gifts with initials, pictures, notes; and customization in any other form or manner.
